When purchasing from Vacs web store, you are entering into a purchase agreement with Avacs d.o.o. (Avacs), Tivolska 48, 1000, Ljubljana; Slovenia; VAT number; Si42215439. Buyers shopping from this site are companies or authorities, operating within the European Union, with a valid VAT number.

How to order

Ordering via Web Store When you have found the product/products you’re interested in, just click on the “Buy now” button (no obligations attached). To add the correct quantity of your product (default when clicking is 1 unit), change the quantity and click “Update cart”. To remove a product from your shopping cart, mark the remove checkbox in front of the product and click “Update cart”. In order to proceed with you purchase, click “Check out”, or else click on ”Continue shopping”. If selecting “Check out”, you will be asked to register if you are a fist time customer or login if you are a returning customer. (The session is always encrypted when being in this area or logged on. Encryption by SSL certificate of trusted authority.) At registration you’re asked to fill in your personal/company information. After the registration a confirmation is sent to you by email. Next, you will go through some steps where you confirm or change your delivery information, see your estimated shipping cost, select your method of payment and confirm or edit the products you’ve selected. You can cancel your order at any time or send the order by clicking “Confirm order” in the last step. After the order is placed a confirmation is sent to you by email.

Conclusion of Contract

When clicking “Submit Order” you are agreeing a binding order for the items in your shopping cart. A confirmation of the order will immediately follow the order submission. The bill of sale arrives with our order confirmation at the time of delivery. All orders are subject to acceptance and to availability of the goods ordered; Avacs is entitled to refuse any order placed by the buyer. The Buyer undertake that: all details provided to us for the purpose of purchasing goods or services offered on our web site are correct. If the Buyer places an especially high-value order Avacs reserve the right to contact the Buyer for further confirmation of your order details, prior to authorization.

Payment Methods

International customers can pay the invoiced amount by PayPal, Visa or MasterCard. The credit or debit card you use to make a purchase from us is your own card or your company’s card, that you are authorized to use, and that there are sufficient funds or credit facilities to cover the cost of any goods or services you order from us. We reserve the right to obtain validation of your credit or debit card details before providing you with any goods or services. Money is reserved from the Buyer’s credit/debit card at the time of ordering, and the purchase fulfilled at the time of delivery. Prices

All prices are displayed excluding VAT if not otherwise stated. The Buyer is obligated to pay taxes for the purchase in the Buyers own country. You’re required to register a valid VAT number (that will be checked). The VAT number of Avacs and the Buyers VAT number, will be outlined on the Buyer’s order confirmation/receipt. Note that if a product has a price at €0, does not mean that the product is for free, it has not just been priced yet.

Shipping and freight cost

The freight cost to different countries within the European Union (EU), depends on what zone the Buyers are in as well as weight and/or what warehouse the products are being shipped from. The final freight cost is displayed in the shopping cart at the end of the purchase. In case the delivery is split into multiple boxes, meaning they might also arrive on different days, does not add extra cost for you. The freight cost is always what’s been calculated in your shopping cart and on the receipt. Buyer must register a valid delivery address (postal box address is not accepted). Order status can be checked under My account.

Shipping to various locations

If the Buyer makes a central purchasing for its organization, and wish to have various products delivered to various offices, this can be done after the relevant security checks are clear and the added costs covered.

Insurance

All packages are sufficiently insured at no extra cost to you. Delivery is deemed to take place when the goods are delivered to the Customer’s nominated address, whereupon the risks of loss, breakage and all damage and all other risks shall pass to the Buyer.

Title

Title in the goods does not pass to the Buyer until payment is received in full by Avacs.

Delivery Terms

Normal delivery time is between 3-7 business days for products in stock. By business days we mean working days, and not weekends and public holidays. Delivery time for special products may vary between 5 days to 4 weeks. This may also apply when standard products are sold out. The correct delivery time will be included in the final order confirmation. Avacs shall use reasonable endeavors to dispatch goods by the date agreed with the customer, but does not accept liability for failure to deliver within the stated time where this is caused by circumstances beyond our reasonable control, such as delays caused by delivery companies or manufacturer lead times. If a delay is likely, the Buyer is contacted by Avacs and advice of the delay.

Order Cancellation

Cancellation of orders by business to business customers is not accepted as many orders are dispatched on the same day the order is placed. In case the Buyer immediately notice that the order was not correct registered, please get in touch with Avacs immediately (call Customer service).

Defective Items, Warranty and Damage during transportation

Return of goods might be accepted for the cases outlined below, look at the details under each headline.

For all cases of returns, the following applies;

You, the Buyer needs to apply for an RMA number (Return Material Authorization) at the Avacs web shop, you find this information under the section ”Customer Service”. The Buyers are responsible for all return shipping costs, including on defective merchandise. Packages arriving as "COD" or "Postage Due" will be refused. You also need to attach appropriate documents in the shipment; that is order confirmation/invoice, the reason for return and the RMA number issued from Avacs. In case the appropriate documents are missing, the return will be refused. The product must be carefully packaged, always use the proper, by the forwarder approved package material and send the shipment as a parcel delivery. Products returned without a separate shipping box or without the original product box will be refused (never write directly on the original box). Damage that occurs during transportation due to negligence by the Buyer will be charged the Buyer. Returned products shall be shipped to a warehouse (normally in Sweden) appointed by Avacs. Look for more details under the headlines below. Note that an issued RMA number is not an approved return. The RMA number is valid for 10 calendar days after issued by Avacs, during what time the delivery shall have arrived at the appointed warehouse. Shipping charges are not refundable under ANY circumstances once an order has shipped. Proof of postage is not proof of delivery and you are therefore strongly advised to send your package by recorded delivery, registered post or courier, and to insure the goods for their full value. Authorized returns will be processed within 10 business days ("business days" exclude weekends, holidays, and the day the package is delivered).

Defective items/Warranty

The Buyer is responsible to inspect the goods delivered, in order to reassure that the delivered products are correct according to the order confirmation, and free from defects. In case a product is defect (DOA or fails within the first 30 days), Avacs shall be notified immediately. Returns must be initiated within 30 days from the date of invoice. For details on how to return, see under "For all cases of returns, the following applies". If the return is approved, Avacs is responsible for the return freight to the customer. Avacs waves the right to decide how to remedy the defected product (replacement delivery, repair or replacement with an equivalent product). Avacs may direct you to the manufacturer in some case, in case there is a good reason for that. If a product fails after 30 days from date of invoice then please contact the manufacturer directly. If you are not sure who the manufacturer is, are not sure how to contact them, or are having problems getting them to replace your product while it is covered under the Manufacturer's Warranty (if any) then please contact us via Customer service and we will do our best to assist you. On receipt of the returned product, we will test it to identify the fault you have notified to Avacs. the product is found to be in good working order without defect, we will return the product to you, and charge a carriage costs in order to cover for freight and handling (minimum payment will €45, but a higher charge might be valid in case the weight of the product exceeds 5 kg). For more information about possible manufacturer guarantees, please refer to the product documentation. The warranty shall not apply if the goods have been worked upon, altered or damaged in any way by the Buyer or its employees or agents, or to goods not used in accordance with the manufacturer's instructions. Unless otherwise stated in the manufacturer's documentation, all goods delivered to a Swedish mainland address carry a 12-month manufacturer's warranty.

Damage during transportation

Buyer must at the point of delivery inspect the goods. Damage that occurs during transportation shall be reclaimed by the supplier to the forwarding company immediately upon receiving of the goods and also noted on the receipt. In case of a transportation damage considered “hidden” Buyer must inform the forwarder and also send an email to Avacs(see more details under section Customer service), no later than 5 calendar days after the delivery.

Refusal to accept the delivery

In case the delivery has not been accepted by the Buyer, and therefore the goods have been returned to the warehouse, Avacs will charge a cost of minimum €45 or with 10% of the order value in case the weight exceeds 5 kg or the value exceeds the amount of €105.

Software

Defective software products may be exchanged for the same title only. Non-defective software that has been opened is not returnable under any circumstances. All software is subject to license agreements or terms established by the software publisher. Buyer must read and agree to the license before using the software. Product Specifications Avacs makes every effort to supply the goods as advertised but reserves the right to supply the goods subject to minor variations in actual dimensions and specifications where these are changed by the manufacturer.

Technical support

Avacs reserves the right to direct the Buyer to the manufacturers for technical assistance (the Buyer will find Links to each manufacturer under the section Links), alternative to the support you can buy from Avacs for specific products, or to other pay-service options. Avacs does not assist with support depending on interaction between different products.

Avacs d.o.o. and Avacs Stores liability

In its dealings with Buyers, Avacs shall under no circumstances be liable for any consequential or indirect damage or loss, however caused, including (but not restricted to) loss of business or profits, loss of goodwill, damage to trading relationships loss of data and other financial loss. ("Financial loss" in this sense does not refer to the price you have paid for the goods, which we may be liable to refund to you, in whole or in part, if the goods are faulty or do not comply with their description). Avacs liability in respect of all other losses shall be limited to the invoiced amount of the relevant order.

Force Majeure

Where in spite of its reasonable efforts, Avacs is unable to perform an obligation due to circumstances beyond its reasonable control, it shall not be deemed to be in breach of its contract with the Buyer.

Changes

Avacs waves the right to change the information on this web site, like prices, terms and conditions, product specifications, without any pre announcement whatsoever.

Jurisdictional sphere

These terms and conditions shall be governed by and construed in accordance with the laws of Slovenia and the parties submit to the non-exclusive jurisdiction of the Slovenian courts.
